“Customer” means the person or entity purchasing products from Solar Wholesalers and in this agreement may also be described as “You”.


Terms of Payment:

Solar Wholesalers accepts the following payment methods:

- PayPal
- Bank Transfer. (Your bank may charge you for this service.)

- Cash (for local customers) or Money Order (for totals over $10,000 we will need to fill out a form 8300 so we will need your Federal ID)
- Check (Business or personal).
- Cashier’s Check. (The IRS consider Cashier’s Checks are equivalent to cash. The bank issuing the check will require a Form 8300 if over $10,000)
Please note*

- that multiple cash or cash equivalent orders over a 12 month period totaling more than $10,000 may need to be reported on a form 8300

- Items will not be shipped until all money orders, checks and bank transfers have been cleared

- Solar wholesalers does not offer Cash On Delivery payment terms

- A fee of $25 will be charged for returned checks or other failed payments


Agreement of Purchase: A purchase agreement is not binding until full payment is made to Solar Wholesalers from the customer and such payment is cleared by our bank. Once full payment has been received Solar Wholesalers will process and ship the order. By signing for any product delivered from Solar Wholesalers, you are agreeing to the terms and conditions listed on this site and are the terms governing the sales transaction between Solar Wholesalers and yourself. Any alterations made by you (the customer) will be considered a material alteration of the agreement and, therefore null and void. As Solar Wholesalers may change these terms and conditions at any time we recommend you check these terms and conditions each time you purchase and accept delivery from Solar Wholesalers.

Installation: Costs charged to You for equipment purchased, in the absence of a contrary written agreement and the charging of a specific additional fee, do not include the costs of installation, permitting or engineering. Solar Wholesalers can provide a list of recommended installers in your area however is not responsible in any way for the installation of the system and does not make any warranty as to the price, qualification or workmanship on any installers so recommended.. It is the Customer’s responsibility to negotiate all aspects, including price with your selected installer. The Customer agrees to release Solar Wholesalers and hold it blameless in relation to any issues relating to the installation.

Warranty as to system output. Solar Wholesalers gives no warranty as to the production of the solar equipment once installed at your property. Installation issues and site specific issues such as direction, azimuth and shading may well affect output of the equipment once installed and any advice given by Solar Wholesalers staff in regard to the output of the system should not be relied on. Accurate advice as to likely output should be obtained from your chosen installer.

Measuring your Roof: Solar Wholesalers staff will usually measure your roof online to get an idea of what number of panels will fit before recommending a size of system for you to buy. However, you should not rely on this measurement and should get a measure and quote from a licensed local installer before ordering and deciding on the size of your final system. Often site specific factors such shading, chimneys, changing roof pitch and restrictions on string sizes can affect the optimal size of system to install on a roof. Solar Wholesalers will not be liable for any advice given as to the appropriate size of system for you to buy.

Warranty as to eligibility for rebates and financial return: Whilst Solar Wholesalers staff may give you advice as to what your financial returns may be  from having a solar system and what rebates or incentives you may be entitled too, this advice is provided only informally and gratuitously and you should not relay on this advice in the absence of contacting  (the relevant authorities including your utility and any other body offering incentives) to ensure you will qualify for their incentive program. It is not possible for Solar Wholesalers (a company that ships solar equipment all over America) to be aware of all the eligibility requirements for all of the solar incentive schemes across America. It is the responsibility of the Customer to determine their eligibility for rebates and incentives and to take a view on the likelihood of incentives continuing. You agree to release Solar Wholesalers from any liability to You or third parties relating to your eligibility for incentives or the financial returns You obtain from the equipment purchased from Solar Wholesalers

Obtaining County, City and Utility Approvals: Unless a specific fee is negotiated Solar Wholesalers is not responsible for obtaining county city or utility approvals that may be required to install the purchased equipment at your property. Solar Wholesalers may introduce you to a company that can provide these services to you but in the instances where it does do this Solar Wholesalers is not liable to you for the performance of such a third party service provider.

Shipping Charges &State Taxes: The total cost, including products, shipping and any applicable state sales tax will be shown on the final invoice from Solar Wholesalers. Prices displayed online do not include shipping or any applicable state sales taxes that might apply.

Process Time: Solar Wholesalers will process the order within 3 business days and ship the purchase within five working days after a payment has cleared unless otherwise agreed. Solar Wholesalers will make every effort to meet your delivery needs but please confirm any special delivery requirements with Solar Wholesalers prior to payment.

Product Availability: Should any product be unavailable we will ship the remainder of your purchase and the outstanding item/s will be place on back order. We can provide estimated availability dates however these are not guaranteed and are subject to shipping schedules and Manufacturers meeting their time commitments to us in this regard.

Order Status: Solar Wholesalers will keep you informed on the status of your purchase via e-mail or phone. You will receive the tracking number via email once the item has been shipped.

Changing of Orders: Should you need to change your order, you can do so provided the purchase has not been shipped. If the purchase has been shipped you will need to ship it back. Once received we will ship the requested product/s. All freight is to be covered by You, the Customer.

Shipping Policy: Solar Wholesalers carefully inspect all products prior to shipment. You, the customer must inspect the shipment upon delivery before signing the release. If you are not signing the release when the shipment is delivered you are responsible to ensure that whoever signs the release has read and understands Solar Wholesaler’s terms and conditions.

We use independent shipping contractors to deliver the purchase. You will be asked to sign for the delivery. This is a legal document stating that the shipment has been delivered in fair condition without any damage. By signing this document you, the customer is waiving any additional claim from the shipper. Therefore, before signing this document you should inspect the package closely. If there is damage (including dents, creases, punctures, tears or scuffs) it should be noted on the delivery receipt. If the package appears to be damaged you have the right to open the package to inspect further. The driver should wait for this. If they do not, mark “Concealed Damage Possible” on the delivery receipt. If there is damage evident you must refuse the delivery and contact Solar Wholesalers.

Cancellation Policy: Should you require to cancel a purchase please contact us during business hours. Purchases can be cancelled at any time prior to shipment. A 10% fee will be deducted from the refund to cover time and resources used on processing the order. If the order has been shipped you will need to pay freight to have the order returned and a 15% fee will be deducted from the refund to cover time and resources used in processing and shipping the order. The refund will be processed within 48 hours of notification of the cancellation or receipt of returned products.

Return Policy: Products purchased may be returned within 30 days of the receipt of the goods. To return products please call us and obtain an RMA number. We will instruct you on where to return the good to. Please clearly indicate the RMA number on the package. You, the customer are responsible for the shipping charges and that the shipper used are a reputable carrier and capable of providing proof of delivery and insurance for the shipment.

When the product/s are received we will provide a refund less a 15% fee to cover costs of time and resources to process the order, provided that the goods are returned in new and resalable condition including all accessories, blank warranty cards and manuals. If these conditions are not met Solar Wholesalers reserves the right to refuse the return or charge for replacement of any missing component.

Warranties: Solar Wholesalers does not manufacture products, we are a distributor only and therefore warranties on all products sold are covered by the manufacturer’s warranty. In the unlikely event that an issue arises with a product within the warranty period we advise you to contact the manufacturer directly. In the event that the item is defective Solar Wholesalers are not responsible and will not send a replacement, simply contact the manufacturer and they will either replace or fix the faulty product. Solar Wholesalers is not liable to You for any failure of a manufacturer to honor their warranty conditions.

Security & Privacy: Security and Privacy are very Important to Solar Wholesalers. All transactions completed online are sent through a secure server and encrypted. When we receive your payment information we will process your payment and ensure that your information is handled at the highest level of security. Any information collected for payment is not stored and destroyed. Solar Wholesalers will not sell or release your personal information to anyone. All information collected will be used for internal purposes only.

LIMITATION OF LIABILITY: To the maximum extent allowable under the Laws of California the Customer agrees that the liability of Solar Wholesalers for any loss or damage to the Customer or any third party arising out of, or related to the purchase of products by the Customer from Solar Wholesalers is limited to 50% of the value of the goods purchased by the Customer from Solar Wholesalers.

Title & Risk of Loss: Solar Wholesalers will arrange for shipment of ordered product(s) to the Customer, Free On Board (F.O.B.) shipping point, meaning title to the product(s) and risk of loss passes to the Customer upon delivery to the carrier. Solar Wholesalers reserves a purchase money security interest in the product(s) until its receipt of the full amount due. Customer agrees to allow Solar Wholesalers to sign appropriate documents on Customer’s behalf to permit Solar Wholesalers to protect its purchase money security interest. Solar Wholesalers will advise Customer of estimated shipping dates, but Solar Wholesalers will, under no circumstances, be responsible for delays in delivery, and associated damages, due to events beyond its reasonable control, including without limitation, acts of God or public enemy, acts of federal, state or local government, fire, floods, civil disobedience, strikes, lockouts, and freight embargoes.

Governing Law and Jurisdiction: Any dispute arising out of or related to these Terms and Conditions or the sales transaction between Solar Wholesalers and Customer shall be governed by the laws of the State of California, without regard to its conflicts of law rules. Specifically, the United Nations Convention on the International Sale of Goods shall not govern the validity, interpretation, and performance of this agreement. Solar Wholesalers and Customer consent to the exclusive jurisdiction and the venue of the State Courts of the State of California, Siskiyou County, to resolve any dispute between them related hereto, and the parities waive all rights to contest this exclusive jurisdiction and venue of such Courts. Finally, the Customer also agree not to bring any legal action, based upon any legal theory including contract, tort, equity or otherwise, against Solar Wholesalers that is more than one year after the date of the applicable invoice.

Severability: If any provision contained in this agreement is or becomes invalid, illegal, or unenforceable in whole or in part, such invalidity, illegality, or unenforceability shall not affect the remaining provisions and portions of this agreement, and the invalid, illegal, or unenforceable provision shall be deemed modified so as to have the most similar result that is valid and enforceable under applicable California law.

Waiver: The failure of either party to require performance by the other party of any provision of this agreement shall not affect in any way the first party’s right to require such performance at any time thereafter. Any waiver by either party of a breach of any provision in this agreement shall not be taken or held by the other party to be a continuing waiver of that provision unless such waiver is made in writing.

Entire Agreement: These terms and conditions, together with Solar Wholesalers’s invoice respecting the products ordered by Customer, are the complete and exclusive agreement between Solar Wholesalers and Customer, and they supersede all prior or contemporaneous proposals, oral or written, understandings, representations, conditions, warranties, and all other communications between Solar Wholesalers and Customer relating to the subject products. This agreement may not be explained or supplemented by any prior course of dealings or trade by custom or usage.
